GENERAL CONTRACT CONDITIONS
1 Acceptance of general conditions
By booking through the booking forms, by telephone, message, email or by participating in the activities, the client accepts these conditions.
The first thing the participant should know is that the organizers will not be responsible in the event of an accident caused by a violation of the following rules and instructions. The driver will be responsible for any damage that the participant may have caused to private property, third parties or himself.
2 Application areas
The general conditions apply to all activities offered by COSTA BRAVA AVENTURA.
The client is the person who books an activity.
By extension, this also applies to any person who participates in the activity (without, however, being obliged to pay the price of the activity).
Minors must be accompanied by an adult and remain under the responsibility of the latter during the duration of the activity.
3 Rates
The price of the activities published on the Costa Brava-Aventura.com website and in the different media is provided for information purposes.
Only the prices that appear in the reservation email sent by Costa Brava Aventura are the exact and real price of the activity. The price is set taking into account the number of participants indicated by the client when making the reservation.
The reservation becomes effective when a completed reservation form is sent by email with the immediate payment of a 50% deposit, as well as these general conditions initialed, dated and signed.
Half-day and full-day departures must be booked at least 48 hours in advance.
Additional participants will not be admitted if the maximum number of participants in the activity has already been reached.
Schedules are set according to availability.
You have the opportunity to indicate your preference when making an appointment.

4 Payment for businesses, companies, non-profit organizations and others.
For companies, the deposit corresponds to 50% of the total price of the activity at the time of booking and must be paid more than 10 days before the activity. Then, the remaining balance must be paid no later than 4 days before the activity date.
The deposit corresponds to 100% of the global price of the activity in case of reservation less than 10 days before the date of the activity.
Only the payment of the deposit confirms the reservation for the defined period and the balance respecting the deadlines mentioned above.
If the amounts are not paid on time, Costa Brava Aventura reserves the right to cancel the reservation.
4.1 Individual and private payment
Individuals have the possibility of paying on the day of the event only in cash and card. 100% of the global price of the activity must be paid before starting the activity.
5 Cancellation
By Costa Brava Adventure:
In the event that the reserved activity cannot be carried out, Costa Brava Aventura will refund the deposit received unless the client prefers to postpone the activity within twelve months following the date of the canceled activity.
In case of cancellation due to causes beyond the control of Costa Brava Aventura such as cases of force majeure (fires, strong storms, etc.), no additional compensation may be required from the client. The organizers reserve the right to cancel the activity at any time, without justification or prior notice.
For the client :
The client cannot cancel his reservation when he has received a duly completed confirmation or when he has paid a deposit.
In case of cancellation, it must be done by phone and email.
Cancellation less than 3 days before the date of the reserved activity will be charged 50% of the amount. The activity is non-refundable in the event that the driver and/or a participant withdraws or cancels during the activity.
6 Development of the activity
The client must make the reservation at the reception, mentioned at the time of the reservation confirmation, less than 15 minutes before the start of the activity. These 15 minutes are used to pay for the activity and deposits, leave and confirm a storage contract, prepare the activity and the safety briefing.
In case of return, the elapsed time will be reduced according to the duration of the activity unless additional compensation is required from the client, regardless of the price of the activity mentioned in the confirmation. In case of return, during an emergency or a group activity with other clients or in case of not participating in the safety briefing, the activity will be considered lost but will be lost in the situation in which it is contacted. in advance. Integrate with the client with a service time of 8 days.
Costa Brava Adventure or any person responsible for the activities reserves the right to respond to the client (or any companions, guests, etc.) for participating in the activity in the event that inappropriate behavior is detected.
7 Responsibility – respect for private property.
Costa Brava Aventura is not responsible for any damage caused by the client during an activity that takes place outside its facilities. If the client causes any damage to the private property (movable or immovable) near which the activity is carried out, he will have to be solely responsible.
The client is aware that he operates with relatively powerful motor vehicles and that as a consequence he incurs a certain risk linked to this activity and undertakes to assume these possible risks with full knowledge of the facts without holding Costa Brava or its representatives responsible.
8 Other specific measures.
The routes are tourist walks, discovery of the region and not sports. Participants will always be accompanied by a guide.
Driver: 21 years old and in possession of a type B car driving license (people still with a license will not be able to drive).
Passenger: minimum 5 years old or height of 1M 10 and under the responsibility of the parents.
Weight: pilot + passenger must not exceed 140 kg per quad in any case.
An individual deposit will be requested before the activity and will be independent of the price of the activity. However, in case of group registration, the deposit will be lump sum, the amount of which will also be mentioned in the confirmation.
A rental contract will be drawn up between Costa Brava Aventura and the client. This contract must be drawn up and signed by the driver of the machine.
In the event that the client (or any person invited to participate in the activity) damages the equipment made available to them or does not respect the safety instructions given in the briefing, they will owe Costa Brava Aventura the amount corresponding to the cost replacement. damaged equipment and which may be deducted directly from the deposit deposited at the beginning of the activity.
The client or participant will have been kept informed of the price of the most common pieces before the start of the activity mentioned in the rental contract. However, if other damage occurs or if the amount of the deposit is not sufficient to cover the cost of the damage caused, the amount to be paid will be the subject of an invoice payable within 8 days following the deduction of the deposit. charged. the day of the activity.
In the event of any dispute, only the court of Figueres in Spain will have jurisdiction.
Participants will not be able to attend the start of the activity if they have not previously attended the information session that will deal, on the one hand, with the use of the machine (positioning to be adopted, location of the accelerator and brake handles, etc.) . and which will also refer to the rules of conduct that must be respected (respect for the traffic code, prohibition of overtaking in the convoy, maintaining a moderate and regular pace without an “accordion” effect, respect for safety distances of at least 6 meters and prohibition of skidding).
